RESOLUTION HANDED DOWN BY THE GENERAL MANAGER OF PUBLIC BUSINESS ENTITY RED.ES MODIFYING THE LIST OF TERMS PROHIBITED OR RESERVED FOR SECOND-LEVEL “.ES” DOMAIN NAMES
Carlos Cano Domínguez, General Manager of public business entity Red.es (hereinafter, “RED.ES”), under the fourth provision of the Instruction of the Chairman of Red.es, dated 12 September 2005, approving the lists of terms prohibited or reserved for second-level “.es” domain names.
WHEREAS
ONE.- The National Plan for Domain Names using the country code corresponding to Spain (“.es”), approved by Order ITC/1542/2005, of 19 May, approving the National Plan for Domain Names using the country code corresponding to Spain (“.es”).
The list of terms included in each of the aforementioned lists was approved by the Instruction of the Chairman of RED.ES, dated 12 September 2005, approving the lists of terms prohibited or reserved for second-level “.es” domain names (hereinafter, “Instruction of 12 September 2005”).
The first of the lists, laid down in Provision Seven, paragraph 2, of the Domain Plan, includes a reduced and updated index of Internet terms whose use in second-level “.es” domain names is prohibited due to their potential to cause confusion. The second, laid down in paragraph 3 of the same provision, grants reserved status to a list of second-level “.es” domain names that may not be freely assigned as they relate to the names of constitutional bodies, other State institutions and officially accredited international and supranational organisations, and, as such, must be reserved. The third and final list, laid down in sub-section 4 of the aforementioned provision, is an updated list of second-level “.es” domain names consisting of toponyms that coincide with the official designations of territorial public administrations and, as such, must be reserved and cannot be freely assigned.
TWO.- The Chairman of RED.ES, by Resolution dated 21 October 2005, delegated to the General Manager of RED.ES, the powers to establish the procedures for assignment and other operations associated with the registration of domain names and Internet addresses using the country code corresponding to Spain (“.es”).
THREE.- The Instruction of 12 December 2005 provides, in its Fourth Provision, that the lists may be updated by resolution of the General Manager of RED.ES, by means of which the terms deemed appropriate to guarantee the efficacy and compliance of said lists shall be included or deleted.
FOUR.- Based on its accumulated experience of carrying out the task of registering “.es” domain names since the approval of the lists by the Instruction of 12 September 2005, the Assignment Authority recommends that the “.es” domain names included in the lists should be updated, adding new terms in order to fulfil the purposes referred to in the previous paragraph.
FIVE.- Specifically, it has become necessary to grant reserved status to second-level “.es” domain names which, without having been previously assigned, coincide with the name of those national parks that have been declared as such in accordance with the provisions of Article 10 of Law 5/2007, of 3 April, on the National Parks Network. A list of these domain names is included as an Annex to this Resolution. These domain names may only be registered by the Autonomous Authority for National Parks (OAPN).
In view of the above,
AGREES
SOLE PARAGRAPH.- To add the terms included in the Annex to this Resolution to the list of second-level “.es” domain names consisting of toponyms that coincide with the official designations of territorial public administrations.
